These terms are between Breckenridge CoLab LLC ("Dialback," "we") and the business that uses the Dialback service ("you"). By using the service you agree to them.

The service

Dialback provides software that sends and receives text messages and email on your behalf, from your business phone number, and tracks leads, requests and follow-ups. We set it up with you and support it.

Your responsibilities

• You own your customer relationships and your customer data. You confirm you have the right to contact the people you load into the service, and that you have their consent to text them where consent is required.
• You approve message content and campaigns before they send. Automated replies send only wording you have approved.
• You will not use the service to send unlawful, deceptive or unsolicited bulk messages, and you will honor opt-outs.
• You keep your login secure and are responsible for activity under your account.

Our responsibilities

• We keep your data in an account that belongs to you alone and use it only to provide the service to you. See the Privacy Policy.
• We do not change your accounting, billing or other systems. Where we read from them, we read only.
• We handle carrier registration for your number and maintain opt-out handling.

Fees

Fees are as agreed with you in writing, billed monthly, month to month. Either party may end the service at any time with notice by email. There are no cancellation fees. Message and carrier charges are passed through at cost unless agreed otherwise.

Ending the service

When service ends, we stop all sending immediately, remove messaging from your number if we hosted it, and delete your data from the service within 30 days. Your phone number stays yours throughout.

Limits

The service depends on carriers, messaging providers and the internet, which can delay or fail. We do not guarantee delivery of any message. The service is provided as is. To the extent permitted by law, our liability to you for any claim is limited to the fees you paid us in the three months before the claim.

Changes

If these terms change, we will email you and update the effective date above. Continued use after that is acceptance.

Law

These terms are governed by the laws of the State of Florida.
